Health care SB 438 Requires self-directed care options and services to be available for: (1) Medicaid waiver recipients; and (2) community and home options to institutional care for the elderly and disabled (CHOICE) program recipients. MRDD Commission HB 1049 Change the name of the MRDD Commission. Health Insurance HB 1311 Insurance coverage for hearing aids. Requires a state employee health plan, a policy of accident and sickness insurance, and a health maintenance organization contract to provide hearing aid coverage. Home health care HB 1028 Requires individuals to register with the division of aging before they may receive compensation for providing attendant care services. Requires individuals in need of self-directed in-home care and a personal services attendant to submit their services contract to the division, and requires the division to keep the contract on file. Requires the division to provide a list of personal services attendants upon request. Provides that certain information may not be released unless the attendant agrees. Requires individuals in need of self-directed in-home care or their fiscal agents to direct deposit and perform other deductions upon the request of the individual providing attendant care services. Requires the division and the office of Medicaid policy and planning to ensure that self-directed in-home care is offered as an option throughout Indiana. Service animals HB 1603 Service animals. Provides that it is the policy of the state that individuals with a mental disability: (1) are encouraged to participate fully in the social and economic life of the state and engage in remunerative employment; and (2) shall be employed in positions with state and local government, public schools, and other entities supported by public funds (current law is limited to individuals who are blind or have another visual or physical disability). Provides that a person with a disability is entitled to be accompanied by a guide animal (instead of a guide dog) in certain public accommodations (including various educational entities) without an extra charge. Provides that an employer, employment agency, labor organization, or joint labor-management committee must allow an employee with a disability to keep a guide animal, hearing animal, or assistance animal with the employee at all times. FSSA & Medicaid HB 1195 Requirements for certain FSSA contractors. Requires an employee of a county office of the division of family resources to directly assist any individual who enters the county office and requests assistance in completing an application for a program serviced by the county office. Requires the office of Medicaid policy and planning to require a contractor that assists in the administration of eligibility determinations to do the following: (1) Implement a document tracking and verification system. (2) Provide a health care facility with a telephone number and specified assistance. Public Transportation HB 1660 Regional transportation districts. Permits counties to establish a regional transportation district to operate and support public transportation systems. Establishes a fee on vehicle registrations, and permits the creation of allocation areas, the establishment of a special allocation of county option income taxes, and the imposition of a food and beverage tax, a county economic development income tax, or a special benefits property tax to provide funding to regional transportation districts. Permits other public transportation agencies to merge into a regional transportation district. Requires the governor to appoint a deputy commissioner for the department of transportation to assist the commissioner with the public transportation responsibilities of the department. Developmental Disabilities HB 1050 Funding for programs for developmentally disabled. Appropriates money to the family and social services administration for the adult guardianship project and for self-advocate programs. Civil rights HB 1250 Civil rights. Extends antidiscrimination and civil rights statutes to include prohibiting discrimination based on sexual orientation, gender identity, national origin, age, disability, and ancestry. Special Education HB 1136 Allows a student with a disability to participate in the ISTEP test or an alternate assessment approved by the state board and as determined by the student's case conference committee. Provides that the case conference committee may determine that the student is eligible to graduate if the student passes an appropriate alternative assessment, maintains a 95% attendance rate and a "C" average or equivalent; and satisfies all nonacademic graduation requirements. Provides that a student with a disability may receive a certificate of completion if the student completes the goals set out in the student's individualized education program. Requests the legislative council to create a study committee concerning special education rules and the placement of special education students during the 2009 legislative interim.
